Hull KR respond to Paul Cooke RFL Ruling Tribunal

Hull KR management have below responded in a statement with regards to the punishment handed out to player Paul Cooke regarding his transfer from Hull FC earler in the year.

Naturally we are disappointed by both the ruling and punishment of the RFL tribunal. It is common ground that the scope of the RFL enquiry was so narrowly restricted by its rules to prevent a full and proper examination of all the facts relevant to this case. Whether that examination takes place will largely depend on Hull FC and their decision whether to bring civil proceedings against Paul and/or the club.

Should they do so (and they should make that decision sooner rather than later) we would more than welcome the opportunity to bring into the public domain the whole facts and background circumstances surrounding Paul's transfer.

It is extremely important to understand that this ruling was wholly based on a narrow and self serving interpretation of the "registration" rules and goes nowhere near answering the all important question of why a player with nine years service from the age of seventeen would become so disillusioned so as to end his playing career with Hull FC.

Until those people connected to Hull FC are called to account to answer that question in an open forum it is premature and lacking in basic understanding for anyone to start claiming the moral high ground and a supposed victory in the name of the integrity of the game.

Bearing that in mind last nights ruling makes not one jot of difference to the strength or otherwise of any civil claim which Hull FC may care to bring and we remain totally confident in the legal advice we are receiving.

Over the next few days we will consult with Paul and our respective advisors and decide on our next course of action, if any. As a club we particularly need to understand why we have been punished by Paul's suspension in circumstances where we have previously been cleared of any wrong-doing. Paul's suspension is punishment through the "back door" for the club and offends the principles of natural justice.

I would like to reiterate that we are delighted to have Paul Cooke as a player at this club. Without doubt he was a significant factor in our maintaining Super League status. We look forward to working with him over the next three years in what we hope are ever improving times for this club.

Finally, and most importantly I would like to reassure our supporters that this finding was no t in any way exposed the club to fresh RFL sanction. Above all it is important that we continue to direct our resources and energies to the bigger issues concerning the club and that is where our focus will be over the coming months.

RFL Statement - Paul Cooke

On Monday 23rd April 2007, Paul Cooke applied to the RFL for free agency status and to register with Hull Kingston Rovers RLFC.

Based on evidence provided to the RFL at the time, the RFL considered that Cooke had a binding contract with the Hull FC club that precluded this request.

On Thursday evidence was provided to the RFL that legal advisors on behalf of the Hull FC club had in fact accepted the player's resignation with immediate effect on 23rd April 2007.

The evidence was provided by legal representatives of Paul Cooke.

Based on clear legal advice from the RFL's external lawyers - the RFL has determined there is no valid reason not to accept the registration of Paul Cooke as a player with Hull KR following the acceptance of his resignation by Hull FC.

Accordingly Cooke is now able to begin playing for the Hull KR club with immediate effect.

Having now dealt with the specific matter of registration, allegations of misconduct against both Paul Cooke and the Hull Kingston Rovers club will be referred to the RFL Compliance Commissioner.

The RFL has no further comment to make at this stage.

The RFL considered the following during their determination of this matter:

- Paul Cooke was employed under a valid contract with Hull FC
- Paul Cooke resigned on 23 April and Hull FC accepted that resignation
- Paul Cooke validly applied to come off the Hull FC Register
- Paul Cooke was therefore entitled to apply to the Hull KR Register
- Paul Cooke and Hull KR have provided the necessary documents for registration to the RFL
- The RFL is required to register a player unless certain provisions apply
- The RFL has considered all of the relevant factors and does not reasonably believe that there are any legitimate reasons that prevent registration
